By accessing or using MakeViral ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

MakeViral provides an AI-powered video generation platform that allows users to create viral video content for social media marketing purposes. Our service includes access to various video templates, AI generation capabilities, and related features.

3. User Accounts

Account Registration

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • You must be at least 18 years old to use our Service
  • One person or legal entity may only maintain one free account

Account Responsibilities

You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized use.

4. Subscriptions and Payments

Billing

  • Subscriptions are billed in advance on a monthly or annual basis
  • All fees are in U.S. dollars and non-refundable except as required by law
  • We reserve the right to change our pricing with 30 days notice
  • Failure to pay may result in service termination

Refund Policy

Refunds are available for unused credits only. If you have not used any credits from a subscription payment or a credit pack, you can ask for a full refund of that purchase within 14 days of the payment by contacting support. Once credits from a purchase have been used to generate content, that purchase is non-refundable, whether or not you are happy with the result, because the AI processing costs are paid when the content is generated. If a generation fails, its credits return to your account automatically. Nothing in this section limits any rights you have under applicable law.

Cancellation

You may cancel your subscription at any time. Your access will continue until the end of your current billing period.

Credits

Credits that come with a subscription can be used while the subscription is active. When the subscription ends, its unused credits expire. Subscription credits are used before other credits. Credits from one-time credit packs do not expire.

5. Content and Intellectual Property

Your Content

  • You retain all rights to content you submit to our Service
  • You grant us a license to use your content to provide and improve our services
  • You are responsible for ensuring you have rights to any content you submit
  • You must not upload content that infringes on others' intellectual property

Generated Videos

  • You own the videos generated through our Service
  • We retain the right to use generated content for marketing purposes with your permission
  • Free tier videos may include MakeViral watermarks
  • Paid tier videos are watermark-free

Our Intellectual Property

The Service, including software, templates, and AI models, is protected by copyright and other intellectual property laws. You may not copy, modify, or reverse engineer any part of our Service.

6. Acceptable Use Policy

You agree not to use the Service to:

  • Create content that is illegal, harmful, or violates others' rights
  • Generate misleading, deceptive, or fraudulent content
  • Create content containing hate speech, violence, or adult material
  • Abuse, harass, or harm others
  • Spam or send unsolicited messages
  • Attempt to gain unauthorized access to our systems
  • Resell or redistribute our Service without permission
  • Use automated tools to scrape or access our Service

7. Service Availability and Modifications

  • We strive for 99.9% uptime but do not guarantee uninterrupted service
  • We may modify or discontinue features with notice
  • We reserve the right to refuse service to anyone
  • Scheduled maintenance will be announced in advance when possible

8. Termination

We may terminate or suspend your account immediately, without prior notice, for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Non-payment of fees
  • Abuse of our Service or staff

Upon termination, your right to use the Service will immediately cease. You may request a copy of your data within 30 days.

AI-Generated Content

We do not guarantee the accuracy, quality, or suitability of AI-generated content. You are responsible for reviewing and verifying all generated content before use.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.

10. Indemnification
